Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Luma Innovations LLC ("Luma Innovations," "we," "us," or "our") regarding your use of the LumaVoice mobile application ("App").

2. License Grant

2.1 Free Trial

LumaVoice offers a 7-day free trial period from the date of first installation. During this period, you have full access to all features without charge.

2.2 Paid License

After the trial period, continued use requires a one-time purchase. Upon purchase, we grant you a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices you own or control.

2.3 License Restrictions

You may NOT:

• Modify, reverse engineer, decompile, or disassemble the App
• Remove copyright or proprietary notices
• Transfer, rent, lease, or lend the App to third parties
• Use the App for commercial purposes without permission
• Circumvent technical protection measures
• Create derivative works based on the App

3. Pricing and Payment

3.1 One-Time Purchase

LumaVoice is available for a one-time purchase of $149.99 USD. There are no recurring subscription fees.

3.2 Payment Processing

All purchases are processed through Apple's App Store. Payment terms and refund policies are subject to Apple's App Store terms and conditions.

3.3 Price Changes

We reserve the right to change pricing at any time. Price changes will not affect existing purchases.

4. Trial Period

• Trial begins upon first app launch
• Trial lasts 7 days from start date
• No credit card required for trial
• Full access to all features during trial
• Trial cannot be extended or reset
• One trial per device

5. Refund Policy

Refunds are handled by Apple according to their standard refund policy. To request a refund:

1. Go to reportaproblem.apple.com
2. Sign in with your Apple ID
3. Find your LumaVoice purchase
4. Select "Request a Refund"

Refund requests are typically processed within 48 hours and are at Apple's discretion.

6. User Responsibilities

6.1 Appropriate Use

You agree to use the App only for lawful purposes and in accordance with these Terms.

6.2 Medical Disclaimer

6.3 Content Responsibility

You are solely responsible for custom tiles, phrases, and content you create within the App.

7. AI Features and Third-Party Services

7.1 AI Sentence Polishing

The AI sentence enhancement feature uses OpenAI's GPT API. By using this feature, you acknowledge that your sentences are processed by a third-party AI service.

7.2 Internet Connection Required

AI features require an active internet connection. Most App features work offline.

7.3 AI Accuracy

While we strive for accuracy, AI-generated suggestions may contain errors. Always review AI-enhanced content before using it.

8. Intellectual Property

8.1 Ownership

LumaVoice, including all code, design, graphics, and content, is the exclusive property of Luma Innovations LLC and is protected by copyright, trademark, and other intellectual property laws.

8.2 Trademarks

"LumaVoice" and the LumaVoice logo are registered trademarks of Luma Innovations LLC. Unauthorized use is prohibited.

8.3 User-Generated Content

You retain ownership of custom tiles and content you create. By using the App, you grant Luma Innovations a license to store and process this content solely for App functionality.

9. Privacy and Data

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers and Limitation of Liability

10.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 No Medical Advice

LumaVoice does not provide medical advice, diagnosis, or treatment. Information provided through the App is for informational purposes only.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMASOFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10.4 Maximum Liability

Our total liability to you for all claims arising from your use of the App shall not exceed the amount you paid for the App.

11. Updates and Modifications

11.1 App Updates

We may release updates, bug fixes, and new features at our discretion. Updates may be required for continued use.

11.2 Terms Changes

We reserve the right to modify these Terms at any time. Material changes will be notified through the App. Continued use after changes constitutes acceptance.

12. Termination

12.1 Termination by You

You may terminate your use of the App at any time by uninstalling it from your device.

12.2 Termination by Luma Innovations

We reserve the right to terminate or suspend your access to the App if you violate these Terms, without refund.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

14. Dispute Resolution

14.1 Informal Resolution

Before filing a claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally.

14.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the American Arbitration Association rules.

14.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits.

16. Export Compliance

You agree to comply with all applicable export and import laws and regulations when using the App.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Luma Innovations regarding the App.
